Acquitted Murder Suspect In The North Country Will Sue

A former North Country college coach who was acquittted in the murder of a 12 year old boy is now suing, and Onondaga County's District Attorney is among his legal targets.

Oral Nick Hillary was acquitted of murder last year in the death of 12 year old Garrett Phillips of Potsdam in legal proceedings that stretched over years. Phillips was the son of his ex-girlfriend. Now Hillary has filed a civil rights lawsuit for malicious prosecution.

 Onondaga County DA Bill Fitzpatrick is among those being sued and so is Onondaga County. Fitzpatrick was among the prosecutors at Hillary's trial. Lawyers for Hillary claim the only reason he was charged and tried in the case is because he was a black man and that evidence was withheld and fabricated during the investigation.
